RC Chronicles — IO LABS, LLC

These Terms of Use ("Terms") are a legal agreement between you and IO LABS, LLC ("RC Chronicles," "we," "us," or "our"). By downloading, installing, or using the RC Chronicles mobile app, website at rollercoasterchronicles.com, or any related services (collectively, the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use RC Chronicles. If you are under the age of majority in your jurisdiction, you may use the Service only with any consent required by applicable law. RC Chronicles is not intended for children under 13.
Your Account
Some features require signing in with Google or Apple. You are responsible for keeping your account secure and for all activity that occurs under your account. Provide accurate information when creating your profile. Guest mode is available in the app with limited features but does not support sync, social features, or cloud backup.
License to Use RC Chronicles
We grant you a limited, personal, non-commercial, non-exclusive, non-transferable, revocable license to use RC Chronicles on Apple devices you own or control and to access the website. This license does not give you ownership of any part of the Service, its content, or its software.
Supporter Subscriptions
RC Chronicles offers optional Supporter subscriptions, billed through Apple. Pricing, free trial duration, and renewal terms are displayed before purchase and may vary by region. Subscriptions automatically renew unless you cancel before the end of the current billing period.
You can manage or cancel your subscription in your Apple ID account settings. Deleting the RC Chronicles app or your RC Chronicles account does not cancel your Apple subscription. Refund requests must be directed to Apple, as we do not process payments directly.
Your Content
You retain ownership of photos, reviews, ratings, trip reports, and other content you submit to RC Chronicles ("Your Content"). By submitting Your Content, you grant IO LABS, LLC a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, display, distribute, and create derivative works from Your Content as reasonably necessary to operate, secure, improve, and promote the Service.
This license includes the right to generate thumbnails and optimized formats, review content through automated and manual moderation, display shared content according to your visibility settings, and retain copies in backups.
You represent that you own or have the rights to submit Your Content, that it does not violate any law or third-party right, and that you have permission from any people identifiable in photos you upload. You can delete Your Content at any time, but aggregated or anonymized data derived from community contributions (such as average wait times) may persist.
Community Data Is Not Official
RC Chronicles includes community-submitted wait times, ride statuses, ratings, reviews, and other crowdsourced information. This data is provided by other users and may be inaccurate, outdated, incomplete, or misleading. We do not verify or guarantee the accuracy of any community-submitted data.
You should not rely on this data for safety decisions. Always follow official park signage, posted wait times, ride restrictions, and staff instructions. RC Chronicles is not an official park operations tool and is not affiliated with, endorsed by, or operated by any theme park or entertainment company unless explicitly stated.
Rules
To keep RC Chronicles safe and useful for everyone, you agree not to:
- Submit false, fraudulent, or manipulated wait times, ratings, locations, or other data
- Harass, threaten, impersonate, stalk, or abuse other users
- Upload content that is illegal, infringing, obscene, hateful, violent, or exploitative
- Submit another person's personal information, image, or likeness without their permission
- Use bots, scrapers, automation, or bulk-access methods without our written permission
- Reverse engineer, decompile, or attempt to extract source code from the app or website
- Bypass or circumvent ads, subscriptions, access controls, or security features
- Interfere with the operation, security, or integrity of the Service
Moderation and Enforcement
We may review, remove, or restrict content and accounts that violate these Terms or endanger users. We may suspend or ban accounts for abuse, fraud, or illegal activity, with or without prior notice. We may also cooperate with law enforcement where required.
Advertising
Free accounts in the app may see ads delivered through Google AdMob. Supporters with an active subscription do not see ads. Ad delivery depends on your region, consent choices, and app configuration. The website does not display ads.
Copyright Claims
If you believe content in RC Chronicles infringes your copyright, contact us at matt@thelabs.io with the following information:
- A description of the copyrighted work you believe is infringed
- The location of the allegedly infringing content within the Service
- Your contact information
- A statement that you have a good-faith belief the use is not authorized by the copyright owner
- A statement under penalty of perjury that your notice is accurate and you are the copyright owner or authorized to act on their behalf
We will remove or disable access to content that infringes copyright and may terminate accounts of repeat infringers.
Third-Party Services
RC Chronicles uses Google and Apple services for sign-in, data hosting, push notifications, ads, content safety, and other functionality. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services or their content.
Intellectual Property
RC Chronicles, including its software, design, features, and non-user content, is owned by IO LABS, LLC or its licensors and is protected by intellectual property laws. Theme park names, ride names, and logos referenced in the Service belong to their respective owners. RC Chronicles is an independent product and is not sponsored by, endorsed by, or affiliated with any theme park unless we expressly state otherwise.
Privacy
Our Privacy Policy describes how we collect, use, and protect your information. By using RC Chronicles, you acknowledge the practices described in the Privacy Policy.
Disclaimers
RC Chronicles is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and availability. We do not guarantee that the Service will be error-free, that data will be accurate or current, that content will always be preserved, or that the Service will meet your expectations.
Limitation of Liability
To the maximum extent permitted by law, IO LABS, LLC and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of RC Chronicles.
Our total liability for any claim arising from these Terms or the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless IO LABS, LLC, its affiliates, and its personnel from any claims, liabilities, damages, losses, and expenses arising from Your Content, your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.
Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts located in Wisconsin, except where applicable consumer law requires otherwise. Nothing in these Terms limits any non-waivable consumer rights you may have under local law.
Termination
By us: We may suspend or terminate your access to RC Chronicles immediately and without prior notice if you violate these Terms, if we suspect fraud or abuse, or if required by law.
By you: You may stop using RC Chronicles at any time. To delete your account and associated data, use the account deletion option in the app Settings or contact us at matt@thelabs.io. Account deletion is permanent.
After termination: Your license to use the Service ends. Content you contributed to the community in aggregated form (such as average wait times) may persist. Sections of these Terms that by their nature should survive termination will survive, including content licenses, disclaimers, limitation of liability, indemnification, and dispute resolution.
General
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and IO LABS, LLC regarding RC Chronicles.
You acknowledge that these Terms are between you and IO LABS, LLC, not Apple. Apple has no obligation to provide maintenance, support, or warranty for RC Chronicles. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You represent that you are not located in a country subject to a U.S. government embargo and that you are not on any U.S. government restricted party list.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or website. Your continued use of RC Chronicles after changes take effect means you accept the updated Terms.
